Whereas NHS foundation trusts have a relatively free hand in determining the procedure and composition of their boards, those of NHS trusts are set out in regulation. There have been numerous amendments to the 1990 regulations and not all iterations are covered here.

The Health and Social Care Act 2008 (Regulated Activities) Regulations 2014 establish the obligations of provider organisations to meet fundamental standards, while the false or misleading information (FOMI) regulations make it an offence to supply certain information knowing that it is inaccurate or if it is accidentally inaccurate through negligence.
